You must be separated for 12 months before applying for divorce. The divorce itself is usually straightforward if both parties agree. Property and parenting matters are separate and can take longer.
Most family law matters settle without going to court. We always aim for negotiated outcomes, which are faster, cheaper, and less stressful. Court is a last resort.
NSW follows a 4-step process: identify assets and debts, assess contributions, consider future needs, and check the outcome is just. There's no automatic 50/50 split.
We can still help. We'll advise on your options, including applying for court orders if necessary. You don't need your ex's cooperation to get legal advice.
